Cottage Policy and Procedures

In order to make your stay as pleasant as possible, the Management requests your co-operation in observing the following as an agreement between the guest and owner (David Blevins) of property referred to as The Cottages of Big Oak and pro (hereinafter called 'Management') under which cottages are permitted to be used by the guest(s):

Reservations & Cancellations

Upon booking, you will be charged a $100 non-refundable processing fee per cottage that will be applied to the balance of your stay. The remainder of the balance will be charged to your listed credit card on the day of your arrival. If you wish to change the method of payment for your remaining balance, please call the property directly.

Cancellations made at least 7 days prior to your reservation will not incur any additional charges. Cancellations made less than 7 days will be charged 1-night rental. Regardless when you cancel the $100 processing fee charged upon booking is not refunded.

Arrival 2:00 PM Self-Check-in with a keypad. Keycode will be provided prior to check-in time.

Departure Check-out time is at 10 AM. Failure to depart upon the designated time will be subject to additional charges. Also, guests, personal belongings will be removed by Management.

Occupancy Requirements 2 adult occupants are allowed per bedroom. Any additional adult guest must have prior approval before arrival. We do not provide additional bedding. Must be attending a wedding at The Barn at Big Oak to make a reservation.

Age Requirement Must be 21 years of age to make a reservation unless prior approval from the owner.
No Subletting Renter may not sublet or assign this lease for all or any part of the premises without the prior written consent of the owner.

Property Access This property requires steps to access Cottages, which may be difficult for guests with limited mobility.

Your safety matters. This property features (3) exterior cameras, (1) facing the carport and side entrance, (1) facing the driveway and front of the house, and (1) facing the back door entrance. The camera is motion-activated and actively records video and sound. There are no cameras in your personal space.

Availability of Non-Essential Amenities Owner will make every effort to ensure all amenities are in proper working order. However, some amenities may occasionally malfunction, including but not limited to electronics (TV/audio, internet service, and appliances. If an outage of one of these amenities should occur, the owner will make a reasonable effort to restore it to working order; however, no refunds will be provided for this reason.

COTTAGE RULES

No Before or After Wedding Parties/Gatherings

NO CANDLES or other sources of open flame are permitted!!!

Furniture: Do not move or otherwise rearrange the furniture.

Smoking is prohibited in the Cottages (this also pertains to e-cigarettes & vapes). Smoking outside is permitted. Please use the furnished butt cans and do not throw cigarette butts on the ground. Violators of this policy will be subject to monetary penalties.

Guest's Belongings Guests are particularly requested to lock the door of their cottages when going out and/or going to bed. The Management will not in any way whatsoever be responsible for any loss/or damage to the Guest's belongings or any other property.

Pets are not allowed on-premises.

Damage or Loss Property The guest will be held responsible for any loss or damage to the cottage property caused by themselves, their guests, or any person for whom they are responsible. If the cottage is left in poor condition, damaged walls or any items from the unit are missing or damaged (such as towels, linens, pillows, accessories, decor, electronics, remotes, etc.) the charges for replacement or repairs will be charged to the credit card on file. An itemized statement will be provided to the guest.

Concern for Others General quiet hours is observed after 10:00 p.m. to 7:00 a.m. Please keep in mind this property adjoins The Barn at Big Oak music is able to be heard until 10 pm

Management's Rights It is agreed that the guest will conduct him/herself in a respectable manner and will not cause any nuisance or annoyance within the cottage premises. The Management has the right to request any guest to vacate his/her room or other areas of the cottage forthwith, without previous notice and without assigning any reason whatsoever, and the guest shall be bound to vacate when requested to do so. In case of the default, the Management has the right to remove the Guest's luggage and belongings from the room occupied by him/her. Relation between Management and Guest Nothing hereinabove shall continue or be deemed to constitute, or create any tenancy or sub-tenancy, or any other right to interact in the lodge premises or any part of portion thereof, in favor of any Guest or resident or visitor, and the Management shall always be deemed to be in full and absolute possession of the whole of the lodge premises.

Government rules and regulations and application of laws Guests are requested to observe, abide by, confirm to and be bound by all applicable acts and laws and government rules and regulations in force from time to time.

Waiver of Liability (Pond):
You understand that you're entering the pond area (50 ft around the pond) at your own risk (No swimming or diving in the pond) You accept full responsibility for any bodily injury arising from entering the pond area and hold the owner harmless. You understand there are potential dangers that the pond area may present to children who are not carefully supervised, as well as the danger to any person who enters the pond area, if a person has health risks, or if a person goes into that area while intoxicated or using any kind of drugs or medication. You agree to be fully and solely responsible for any accidents you may incur. You understand the risks discussed above and agree that you will assume all responsibility for yourself and for the consequences of those in your party. You agree to waive any claim whatsoever against the owner for accidents or claims arising from entering the pond area. All Guests, Lodging and or visiting at the property referred to as The Cottages of Big Oak, in my party acknowledge and agree that they have read and understand this waiver and they acknowledge that confirming below constitutes a binding and enforceable contract between Guests and Owner of property referred to as The Cottages at Big Oak.

Release & Waiver of Liability
I, the undersigned (hereinafter the Guest) hereby irrevocably & unconditionally waive and release & hold harmless from liability the owner (David Blevins) of property referred to as The Cottages at Big Oak, , its owners, agents, and other guests (all four hereinafter known as Releasees) from any & all liabilities, claims, actions, damages, costs, or expenses of any nature whatsoever whether in law or equity, known or unknown, occurring during, caused by, relating to, or arising in any way from being at owners property.
Guest also understands that lodging at our facility may involve voluntary participation in physical activities both indoors and outdoors, and certain exposure to walks, steps, paths, and roads that are uneven. With these and all related activities, there is a certain element of risk. By accepting this waiver, Guest hereby acknowledges that participation and use of our facilities and grounds are at Guest's own risk and that Guest assumes all responsibilities for any and all aspects of participation by both Guest and any children who might accompany Guest. This waiver applies to any and all activities, named and unnamed herein, which are voluntarily participated in by guests and family members & visitors of guests at the property referred to as The Cottages at Big Oak

Guest also understand that this Release & Waiver of Liability irrevocably and unconditionally releases and holds David Blevins (Owner of property referred to as The Cottages at Big Oak harmless from any financial or other liability for any injury, bodily harm, sickness, illness, or loss of life that I as a Guest or my family member or friend may suffer and from any economic harm or loss of property occurring during, caused by, relating to, or arising in any way out of staying at property of David Blevins.
I HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS, NOW KNOWN OR HEREAFTER KNOWN, AGAINST THE VENUE, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, MEMBERS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASEES"), ON ACCOUNT OF INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR ATTRIBUTABLE TO MY USE OF THE VENUE, WHETHER ARISING OUT OF THE NEGLIGENCE OF THE VENUE OR ANY RELEASEES OR OTHERWISE. I COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST THE VENUE OR ANY OTHER RELEASEE, AND FOREVER RELEASE AND DISCHARGE THE COMPANY AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH CLAIMS.

INDEMNIFICATION. WE SHALL DEFEND, INDEMNIFY, AND HOLD HARMLESS DAVID BLEVINS AND ALL OTHER RELEASEES AGAINST ANY AND ALL LOSSES, DAMAGES, LIABILITIES, DEFICIENCIES, CLAIMS, ACTIONS, JUDGMENTS, SETTLEMENTS, INTEREST, AWARDS, PENALTIES, FINES, COSTS, OR EXPENSES OF WHATEVER KIND, INCLUDING REASONABLE ATTORNEY FEES, FEES AND THE COSTS OF ENFORCING ANY RIGHT TO INDEMNIFICATION UNDER THIS AGREEMENT, AND THE COST OF PURSUING ANY INSURANCE PROVIDERS, INCURRED BY/AWARDED AGAINST INDEMNIFIED PARTY IN A FINAL NON-APPEALABLE JUDGMENT, ARISING OUT OR RESULTING FROM ANY CLAIM OF A THIRD PARTY RELATED TO OR ARISING OUT OF RENTERS' USE OF THE PROPERTY OWNED BY DAVID BLEVINS.

THE MANAGEMENT RESERVES TO ITSELF THE RIGHT TO ADD TO, OR ALTER OR AMEND ANY OF THE ABOVE TERMS, CONDITIONS AND RULES WHICH ARE A PART AND AN ABSTRACT OF THE LODGING ACT.
